What is a notary?
A notary is an impartial official who is authorized to draw up authentic documents, also known as notarial deeds. In these deeds, agreements between the parties and their consequences are officially recorded. A notary is appointed by the king and has taken an official oath. In this oath he swears that he will perform his duties honestly, impartially and accurately, that he will observe the law as strictly as possible and that he will observe strict confidentiality regarding the content of the deeds drawn up by him. This legislation is laid down in the Civil Law Notaries Act and is binding on all members and bodies affiliated with the Royal Notarial Association (KNB).

In addition to drawing up and signing official documents, civil-law notaries are also often involved in conducting (legal) research. They also ensure that all deeds, dated, are preserved and that a copy is made (also referred to as ‘grosse’).
Many notaries on Curacao are supported by notary clerks, who prepare, maintain, check and finalize files. They also investigate data at the government and the Chamber of Commerce. During their work, civil-law notaries also have to deal with, for example, company lawyers, lawyers, legal secretaries, brokers, legal assistants and mortgage advisers.
How do you become a notary?
To become a notary, you must have completed a bachelor’s and master’s degree in notarial law at a university. This program is offered in Amsterdam (UvA and VU), Groningen, Leiden, Nijmegen and Utrecht. Courses offered include law of persons and family law, inheritance law, matrimonial property law and real estate law.
After completing your studies, you can apply for a job at a notary’s office. For the first six years of your career, you are a candidate civil-law notary, which means that you have no final signing authority and that the civil-law notary has final responsibility. Only in case of deputy (when the notary is absent), the candidate notary bears full responsibility.
