Buying Land in Curaçao: Ownership, Zoning and Building Rules

Before buying a lot in Curaçao, check ownership, zoning, building rules, soil, access, utilities and the total construction budget.

Buying Land in Curaçao: Ownership, Zoning and Building Rules

In brief

  • Verify title, boundaries, zoning and permitted construction before committing.
  • Investigate soil, slope, drainage, access and utility connections.
  • Calculate land, design, permits, construction, infrastructure and contingency as one project.

A lot with a sea view or a quiet inland position can be an excellent starting point for a home in Curaçao. The purchase should nevertheless be treated as the first phase of a construction project, not as an isolated land transaction. Compare the available lots for sale in Curaçao only after defining what you want to build and what the complete project may cost.

Ask the civil-law notary and your advisers to confirm who owns the land, which property right is being transferred and whether mortgages, easements or other registered restrictions apply. The cadastral boundaries and surface area should match the site you have viewed. If access crosses another parcel, establish the legal right of way rather than relying on current use.

Check zoning and building permission

Ownership does not automatically mean that every design is permitted. Verify the zoning designation, allowed use, building lines, height, setbacks, site coverage and any architectural conditions. A resort or subdivision can add private design rules and approval procedures. Discuss a preliminary design with a qualified local architect before the purchase becomes unconditional.

Investigate the terrain and soil

Slope, rock, fill, drainage and exposure influence both design and cost. A steep or irregular lot may require excavation, retaining walls or special foundations. Low-lying land deserves careful water-management analysis during heavy rain. A soil or geotechnical investigation can be valuable when conditions are uncertain or the planned structure is substantial.

Access and utility connections

Confirm that the lot has usable legal and physical access. Ask where electricity, water, internet and sewage or septic solutions are available and who pays for extensions. The distance from existing infrastructure can materially change the budget. Also consider construction access for trucks, storage and cranes.

Build the total project budget

Include the land price, buying costs, surveys, architect and engineering fees, permits, site preparation, construction, external works, utility connections, landscaping and finance. Add a realistic contingency for price changes and unforeseen ground conditions. If financing is needed, discuss how the lender releases funds during construction in the guide to mortgages in Curaçao.

Land in a resort or subdivision

Review the owners’ association or resort documents, monthly fees, construction deadlines, approved contractors, rental policy and design standards. Ask which roads and shared facilities have already been delivered and which obligations still rest with the developer or owners.

Safe purchase checklist

  1. Define the intended building and budget.
  2. Confirm title, cadastral data, access and registered rights.
  3. Check zoning, permits and private building rules.
  4. Investigate terrain, drainage, soil and utility availability.
  5. Obtain preliminary construction and infrastructure estimates.
  6. Use appropriate conditions in the offer and purchase agreement.
