Mediation is a discipline that focuses on professional guidance of parties by a neutral third party in a (communication) process in which the parties see their conflict as their common problem and also find a solution together. Mediation is a creative solution to conflicts and overcoming conflicts.<\/p>\n
For parties who don’t want to waste money, time and energy to authoritarian dispute resolution, such as law, mediation is an great solution .Parties participate in discussions on a voluntary basis, where one itself has control and can determine how the communication or the process is (self-determination or autonomy). The mediator has no decision-making role, he \/ she acts only as a facilitator and should be accepted by both participants and needs to win their trust. The neutrality, impartiality and independence needs to be maintaint. All parties are to respect the confidentiality of the information contributed by the participants. This disclosure also applies to the mediator.<\/p>\n
Conflict Mediabel?
\nGlobal is a conflict mediation eligible (read: it is effective) as well as:
\nNegotiation Readiness (motivation of participants). Are they willing to sit down to dinner together to discuss what divides them? One can listen to and reflect? In other words, gain insight into their own situation and that of the other and with some creativity to look for solutions.<\/p>\n
The parties have adequate opportunities to offer each other back and forth slightly. By limited Yes \/ No question lacks space. Fraud, debt collection, criminal offenses and interpretation of EU law are NOT negotiable. Highly escalated conflicts may affect the willingness to negotiate and space and there is a chance that a conflict is not mediating table.<\/p>\n
Follow up
\nIf customers are independently interested in mediation, then I suggest that I met both separately call (each party as long I speek). I will provide more information to answer (among others on the stages of the mediation) and demand (time and costs of mediation). I will also willing and voluntary nature of the parties and the type of conflict (the mediating table) scans.<\/p>\n
If the conflict is mediation and eligible parties are enthusiastic I send to both parties separately a directory of mediation, the mediation agreement and the rules of conduct that apply to the mediation shall apply. This is for information only. Also, I mention the dates, time and location for a first mediation session.<\/p>\n
